Terms of service
The agreement between your business and SMB Tiller LLC for use of this website and the SMB Tiller platform.

1. Who these terms are between
These terms are an agreement between SMB Tiller LLC (a Delaware limited liability company) and the business that uses this website or the SMB Tiller platform. If you accept them on behalf of a business, you confirm you are authorized to bind it. “You” means that business.
Where you and we have signed a separate written agreement, that agreement governs and these terms fill any gaps in it.
2. The service
SMB Tiller provides software that connects to advertising, commerce, operations and payments platforms on your authorization, and produces reporting that joins advertising spend to fulfilled work and collected payments.
We may change, add or withdraw features. Where a change materially reduces a feature you rely on, we will give reasonable advance notice.
3. Your account
- Give accurate registration information and keep it current.
- Keep credentials confidential; you are responsible for activity under your account.
- Tell us promptly at navendu@smbtiller.com if you suspect unauthorized access.
- Ensure everyone you give access to complies with these terms.
4. Connected platforms
The service works by connecting to third-party platforms. When you authorize a connection:
- You confirm you own the connected account, or are authorized by its owner to connect it and to instruct us to act on it.
- You remain bound by that platform’s own terms and policies. Nothing here overrides them, and we are not responsible for a platform’s availability, pricing, decisions or changes.
- You may revoke a connection at any time, through the platform or by asking us. Revoking may stop features that depend on it.
- We act on your instructions within the scopes you granted, and no further.
Platform names appearing on this site identify systems we integrate with. They are the trademarks of their owners and their appearance does not indicate any partnership, endorsement, certification or approval.
5. Advertising accounts and spend
- Advertiser accounts are established in your name, or in your client’s name, and remain theirs. On request we will transfer administrative access and provide account identifiers.
- Advertising spend is billed to you by the advertising platform. It is not our revenue, and we do not mark it up or re-bill it.
- Where we manage campaigns for you, our fee is separate, disclosed before purchase and itemized on invoices. See our third-party advertising practices.
- Advertising results depend on markets, competition, creative and platform decisions outside our control. We make no guarantee of any particular result.
6. Payments and financing
Payment processing and consumer financing are provided by independent, licensed third parties under their own agreements with you. SMB Tiller is not a bank, not a lender, and not a money transmitter. We do not hold, route or take custody of your funds or your customers’ funds, and we make no credit decisions.
7. Fees
- Fees are those set out in your order or quote. Our pricing page explains the components.
- Fees are payable in advance unless the order says otherwise, and are exclusive of taxes.
- We may change fees on 30 days’ notice, effective at your next renewal.
- Service may be suspended for unpaid amounts, after notice and a reasonable opportunity to cure.
8. Your data
Data you provide, and data we retrieve from platforms you connect, remains yours. You grant us the license needed to operate the service for you. We handle it as described in our privacy policy. You may export it at any time and request deletion through our data requests process.
9. Acceptable use
You agree not to:
- Use the service unlawfully, or to promote unlawful or deceptive offerings
- Connect an account you are not authorized to connect
- Circumvent a platform’s terms, rate limits or technical controls through the service
- Attempt to access another customer’s data, or probe or disrupt the service
- Resell or provide the service to third parties except under a written channel agreement with us
10. Intellectual property
The service, the software and the SMB Tiller name and marks are ours. These terms grant you a limited, non-exclusive, non-transferable right to use the service for your business during your subscription. Feedback you send us may be used without obligation.
11. Term and termination
Either party may terminate on 30 days’ notice, or immediately for a material breach not cured within 30 days of notice. On termination your access ends, and we will make your data available for export for 30 days before deleting it as described in the privacy policy.
12. Disclaimers
The service is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, nor any commercial result.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability arising out of these terms will not exceed the fees you paid us in the twelve months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.
14. Indemnity
You will defend and indemnify us against third-party claims arising from your unlawful use of the service, your content, or your breach of a connected platform’s terms. We will defend and indemnify you against third-party claims that the service infringes a third party’s intellectual property rights.
15. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. The state and federal courts located in Delaware have exclusive jurisdiction, and both parties consent to that jurisdiction.
16. Changes
We may update these terms. For material changes we will give at least 30 days’ notice by email or in the product. Continued use after the effective date means acceptance.
